Terms of Service

1. Our services

Hughesy AI Automation (ABN 87 609 034 598) provides website design and development, landing pages, AI receptionist and voice agent systems, missed-call text-back automation, CRM and lead-pipeline automation, automated follow-up, booking and reminder systems, review generation and reputation management, customer reactivation, email and SMS marketing, local SEO and Google Business Profile management, paid advertising management, content and social media systems, quote and invoice automation, and business dashboards and reporting. Services are delivered remotely, Australia-wide.

2. Engagement and scope

Each project begins with a free preview or enquiry-system review to identify where enquiries are being lost. Following that, any work that becomes a project is quoted in writing before work begins. The written quote defines the scope, deliverables, timeline, and cost. Work outside the agreed scope is quoted separately.

We do not guarantee rankings, lead volumes, conversion rates, or percentage improvements. Systems can be configured around your approved consent, sender-identification and opt-out processes. Each business remains responsible for confirming its legal and industry-specific obligations.

3. Pricing and payment

All pricing is in Australian Dollars (AUD) and excludes GST. Before we commence work, we provide a written quote and confirm the final pricing. You have the opportunity to review and approve all costs before any services are delivered.

Telephony, SMS, advertising spend, and third-party software subscriptions are charged at cost and are separate from our fees. These costs are confirmed in writing before work begins. Payment terms, including any deposit requirements, are outlined in the project agreement.

4. Testing and launch

A workflow must be tested before it goes in front of customers. That testing stage is not optional and is built into every project. We test against agreed scenarios before launch. Launch does not occur until testing is complete and you have approved the system.

5. Intellectual property and ownership

You own the content, text, images and data you provide to us. On final payment of all fees for a project, ownership of the website files, and control of the domain and hosting accounts set up for your project, transfers to you, and we confirm the handover in writing.

Until final payment is received, Hughesy AI Automation retains control of the build and any services running as part of it. Where a project is paid in instalments, the site and any connected systems remain under our control until the final instalment clears.

Hughesy AI Automation retains ownership of our underlying systems, templates, frameworks and tools used to deliver services. You are licensed to use these as part of your project but cannot redistribute or resell them.

6. Third-party services

Our services involve connecting to and configuring third-party platforms, including AI providers, telephony services, CRM tools, email and SMS platforms, and advertising platforms. Each provider has its own terms of service, pricing, data practices, and approval processes that are outside our control.

We will tell you during the free preview or enquiry-system review if a required integration is not practical with your existing software. We do not control the availability, pricing, or data handling of third-party providers.

7. Limitation of liability

We provide our services to the best of our ability. We are not liable for indirect, incidental, or consequential damages arising from the use of our services, including loss of revenue, data, or business opportunity. Our total liability is limited to the amount you have paid for the specific service in question.

We are not liable for the actions, outages, or data practices of third-party providers. We are not liable for outcomes that depend on factors outside our control, including enquiry volume, market conditions, or how your team uses the system after handover.

8. Cancellation

For monthly or ongoing services, you may cancel at any time by providing written notice. Cancellation is effective at the end of your current billing period. Fees already paid are non-refundable unless otherwise agreed in your service agreement. One-off project fees are governed by the project agreement.
